ALLEGED INDECENT ASSAULT. - William
Miller was charged with indecently asssult-
ing a child of 9 years of age, named Fanny
Emily Marter. - The child, after having
satisfied the Court that she under-
stood the nature of the oath, deposed
that she was the daughter of Frederick
Charles Marter, who was in Fiji, but that she
and her mother were living with her brother
who was the proprietor of the London
Dining Rooms. On Saturday night, about
10 o'clock, the servant girl put her in bed.
Shortly afterwards the prisoner came into
her room. (The child here described the
particulars of the assault, which are unfit for
publication.) Prisoner had been cooking at
her brother's restaurant. She was positive
that prisoner was the man who came into the
room - Sarah Ann Marter stated that she
was the mother of the witness. At 20 minutes
past 10 o'clock she heard the child crying
and at once went to her bed-room to see
what was the matter. She found the prisoner
there, and at once seized him and
held him until lights were brought,
She swore positively as to prisoner
being the man she found in her daughter's
bedroom. Adeline Brisline, servant at the
London Dining Rooms, corroborated the
evidence of previous witnesses. - Prisoner
stated that the (sic) heard the child crying, and
went to the door to ask her the reason. He be-
lieved that some man had been in the child's
bedroom, but he was not that man. - His
Worship considered that there was not suffi-
cient evidence to convict prisoner of a com-
mon assault, but that there was no doubt
prisoner had been in the bedroom, where he
had no right to be. He would, therefore,
have to pay a fine of 40s. and costs, or be
imprisoned 14 days. - This was all the busi-
ness, the Court rose.
