    • There is a Marriage Settlement dated the 21st day of June A.D 1839 for
      Sarah Cecelia Marter which relates to the passage below:

      Sarah Cecilia Marter, married Charles Ralph Jarvis, a St. John merchant
      on 29-Jan-1839; he was almost 30 and she was not yet of age being but
      18. Her father, Thomas Peter Marter, apparently would not consent to the
      marriage, it possibly appearing to him that Jarvis was looking for that day
      when his wife became of age and would come into a sizable estate over which he
      as her spouse would have control. It was at this point prior to the marriage that
      this marriage settlement came into being. It, in essence, provides that Sarah
      Cecilia Marter’s separate property, both present and future, upon her becoming
      of age, shall be placed in trust with Thomas P. Marter, Ralph M. and Edward
      C. Jarvis who as Trustees are authorized to distribute the proceeds
      therefrom for her benefit. This agreement is dated the same date as the
      marriage.

      A subsequent document between Thomas P. Marter and Charles R. Jarvis
      was executed six months later, 31-Jul-1839, transferring to the Trust thirteen
      shares of the capital stock of the commercial Bank of New Brunswick at present equal to the sum of three hundred and twenty five pounds… and also the further sum of 52 pounds, 2 Shillings and five pence, and additionally some real estate conveyed
      to Sarah Cecilia by one Charles Simonds.

      At this point it becomes rather obvious that Thomas P. Marter has little, if any, confidence in his son-inlaw. Perhaps rightly so, for while all the details are not known, the 1851 census lists daughter Cecilia Jarvis and granddaughter Marian living with him. Further, future references to Marian refer to her — not as Jarvis — but as Marter.
      It would appear that Thomas P. Marter was so concerned in keeping any inheritance
      of daughter and granddaughter out of the hands of Jarvis that he forced Jarvis to agree to the marriage settlement, and additionally in the event of the early demise of his daughter, he adopted his granddaughter, Marian, so that Jarvis could not gain control over any inheritance Marian might receive.

      "Marian Jarvis was the only child of the marriage of Sarah Cecilia Marter
      and Charles Ralph Jarvis. Sarah Cecilia’s father, Thomas Peter Marter, would
      not sanction the marriage unless Jarvis would sign a prenuptial document agreeing
      that any assets the wife brought to the marriage would be turned over to a
      trust, of which he was a trustee, to be reinvested, and that any income therefrom
      would be her separate property and in no way subject to Jarvis’ control.
      (See 23c.) Upon the birth of Marian, Marter recognized that in the event of
      Sarah Cecilia’s early demise, Jarvis might wind up with control of his granddaughters
      inherited property, so he simply adopted his granddaughter.
